ENEMIES OF THE PEOPLE was the Daily Mail headline on 4th November 2016. It referred to three senior judges who had ruled, in effect, that Brexit could not be triggered without an act of parliament. At the time, Liz Truss was lord chancellor and justice secretary. Later, one of the judges said she had been ‘completely and absolutely wrong’ to think she was under no constitutional duty to defend the judiciary against unwarranted attacks.
Dominic Raab is not likely to remain justice secretary once the new prime minister takes office. What challenges will the incoming lord chancellor face? And how will the new prime minister restore public confidence after succeeding a colleague who has played fast and loose with the rule of law?
